What you may not have known about the EULA Agreement


Hey guys! I'm here to talk about some things that some of us may not have known about the EULA agreement.

1) We basically gave them permission to steal our content such as mods, texture packs, skins, etc, and add them to regular Minecraft without credit.

"If you make any content available on or through our Game, you must give us permission to use, copy, modify and adapt that content. This permission must be irrevocable, and you must also let us permit other people to use, copy, modify and adapt your content. If you don‘t want to give us this permission, do not make content available on or through our Game. Please think carefully before you make any content available, because it will be made public and might even be used by other people in a way you don‘t like."

Did any of you see this in the agreement? If not, there it is, in a nice little quotey thingy Brenna showed me :D Tehehehe. 

Basically it's saying this:

"We, Mojang, can use anything you create for our game including Mods and things of that nature. By signing this agreement, you give us permission to use any of your content for our Game even without your written permission. We'll also be letting other people edit/copy/use it. If you don't want us to do this, don't share it. Think carefully before doing this, because people might steal it and use it in ways you do not like."

Let that sink in. They might steal your Mods. Technically, they even own Sneyersul, even though it says Pat is the owner. So what happens if they try and take over? 

 

2) We can't give Minecraft as Christmas presents or sell it on Amazon :(

"The one major rule is that you must not distribute anything we‘ve made. By “distribute anything we‘ve made” what we mean is “give copies of the game away, make commercial use of, try to make money from, or let other people get access to our game and its parts in a way that is unfair or unreasonable”. So the one major rule is that (unless we specifically agree it – such as in brand and asset usage guidelines) you must not:

  • give copies of our Game to anyone else;
  • make commercial use of anything we‘ve made;
  • try to make money from anything we‘ve made; or
  • let other people get access to anything we‘ve made in a way that is unfair or unreasonable."

:V Mojang wouldn't steal servers, and I doubt they would try taking over teeny servers like Sney. It's true that they do take mods, but that's been happening for a while now (Last I checked the potions came from a mod, and the models for horses came from Mo' Creatures, at least, that's what i've heard). So that's old news, but they only go after mods that would help improve the game, IE - taking the horse models from Mo Creatures since everyone begged for horses or adding potions since they thought it'd add a cool flare to survival play.

And, christmas presents =/= selling You don't gain any profit if you literally buy the game and give it to someone for free. On the other hand, if you take a copy of the game, say, the card you get from purchasing it in stores, and try to sell it for a lower/higher price, THAT'S bad.

"give copies of our Game to anyone else" only applies to selling the game. Emphasis on SELLING, and if it doesn't apply to selling, then it applies to those who will give away their old account (sometimes for money), thus making Mojang lose money (which might I add isn't too big of a deal considering there's millions of minecraft accounts now and growing) "Try to make money from anything we've made" can apply to the game, as well as the merchandise Minecraft has on its website. Such as re-selling a vinyl creeper plush or hoodie for a lower or higher price.

Basically, buy shit for your friends via minecraft. But don't sell it. As long as Mojang gets some kind of profit, you're good.

Here's the problem.

 

Mojang, being a massive company NOW owned by Microsoft drafted up this EULA to benefit them as a company in the long run.

 

In tadem with that is this:

Sneyersul could be redistributed.

While that may hold true, we don't possess a database of players capable of even showing up on their radar of "key points."

My stuff can be used by Mojang without my permission

 Of course. They're a company giving you their source code for free essentially. When you make skins you're using their source code to generate and create these skins for players to use. When you make mods, etc.

You can't gift or sell minecraft

As Ghosts said:

selling minecraft = / = gifting minecraft

Generally aren't the same thing, so you should have no issues when it comes to giving MC to a friend. Redistribution without contract or consent by the company can result in heavy lawsuits.

 

The sole purpose that mojang doesn't want people making commercial use out of modifications to the game is because it was generated and modified under original source code of minecraft (e.g. The knicks and knacks that make the game itself as a whole)

 

You have to put yourself in the company's shoes for a second and think if it's fair for their success to be resold by someone else for something relevant to the game.

It's not too late. They probably haven't noticed your work yet. Remove them from public view. As long as they don't see it, they can't use it.

By posting them to public view; modders are giving permission for players and server owners alike to USE the modificiation. One thing that can be done is having the modified source code not viewable to public eye. (E.G. Would be the Shotbow Network and Mineplex. Almost everything regarding their system is done by them or done by hired moderators.

 

When you purchase minecraft, you agree to every term and condition and are therefore informed when the EULA changes. If you feel as though you're within a breach of T&C you contact them and discuss the matter.

 

Mojang CANNOT redistribute your modification onto their game for profit, as that is plagarism and also cosidered theft. 

 

Think of it this way.

 

You make a mod and Mojang uses it on their game, without for permission and profits from it.

is the same as:

You take minecrafts source code and add your mod to the game, and then redistribute the game for profit.
